Progressive Rep. Alexandria Ocasio-Cortez (D-NY) faced backlash after her remarks about Daniel Penny, who was acquitted in the subway chokehold death of Jordan Neely, stirred heated reactions.

Some criticized the congresswoman as “delusional” for suggesting commuters should be wary of Penny following his high-profile trial.

Penny, a 26-year-old former Marine, was cleared of all charges by a Manhattan jury on Monday after a contentious case involving the caught-on-camera death of Neely, a homeless man, during an altercation on an uptown F train last year.

The jury’s decision followed prosecutors dropping a manslaughter charge after jurors deadlocked on the case.

In the aftermath, a resurfaced video of Ocasio-Cortez on social media reignited debate. In the clip, which has been viewed over 540,000 times on X, Ocasio-Cortez criticized Penny’s demeanor, citing a lack of remorse as a troubling indicator.

“If we do not want violence on the subways and the point of our justice system is a level of accountability to prevent a person who does not have remorse about taking another person’s life,” she said in the video. “I mean, even people who have engaged in manslaughter or have taken a life accidentally express remorse.”

She added, “The fact that a person has expressed no remorse indicates a risk that it may happen again. And if we do not want to unleash that level of violence, then we should exert a level of accountability to prevent that from happening.”

Neely, 30, died on May 1, 2023, after Penny restrained him in a chokehold for six minutes. Witnesses said Neely had been aggressively shouting at passengers and issuing threats, which terrified commuters.

Penny and others testified that Neely made alarming statements, including that he didn’t care if he returned to jail and that he was willing to k*ll.

When asked by the New York Post before the trial whether he would act similarly in the future, Penny firmly replied, “I would — if there was a threat and danger in the present.”

After the trial, people were quick to come to Penny’s defense, many hailing him as a hero.

“They should rename that the Daniel Penny line. The only safe subway in New York,” one user posted on X.

“No honest person believes we need fewer people willing to step up and protect work and children from being assaulted on the subway,” wrote another.

Others took aim at Ocasio-Cortez directly. “AOC never fails to surprise me with her utter stupidity!” one critic exclaimed.
