Manhattan DA Opposes Trump’s Bid to Overturn Hush Money Conviction
Manhattan District Attorney Alvin Bragg has urged a judge to reject President-elect Donald Trump’s bid to have his hush money conviction overturned, according to a court filing from earlier this week.
In the detailed filing, prosecutors argued against Trump’s request, asserting that the jury’s verdict should stand and that Trump should ultimately face sentencing after being found guilty earlier this year of falsifying business records.
“The extreme remedy of dismissing the indictment and vacating the jury verdict is not warranted in light of multiple alternative accommodations that would fully address the concerns raised by presidential immunity,” the prosecutors stated.
Trump’s legal team has maintained that, as president-elect, Trump is shielded from legal proceedings due to presidential immunity and constitutional protections.
“Wrongly continuing proceedings in this failed lawfare case disrupts President Trump’s transition efforts,” Trump’s attorneys said in earlier arguments this month.
Last month, Judge Juan Merchan indefinitely postponed Trump’s sentencing to allow both sides time to argue for or against dismissing the case.
Prosecutors have suggested that, at most, sentencing and related appellate proceedings could be delayed until after Trump completes his presidential term.
They warned that dismissing the case would “subvert the compelling public interest in preserving the jury’s unanimous verdict and upholding the rule of law.”
Trump’s legal team also pointed to President Joe Biden’s recent pardon of his son, Hunter Biden, which was justified by claims of unfair treatment by the Department of Justice (DOJ).
Trump’s attorneys argued that the same DOJ “sent” former DOJ official Matthew Colangelo to work with Bragg’s office on prosecuting the former president.
However, prosecutors countered that no evidence exists to suggest DOJ coordination with Bragg’s office in the case against Trump.
Trump’s conviction in May stemmed from 34 counts of falsifying records related to a payment made to adult film actress Stormy Daniels during the 2016 presidential campaign.
While the charge carries a maximum sentence of four years in prison, sentencing guidelines indicate Trump would likely face a much lesser penalty if the process moves forward.
Legal experts have pointed out that, during Trump’s tenure as president-elect or while in office, he cannot be subject to jail time or probation, as such penalties would interfere with his ability to fulfill presidential duties.
Overall, it’s past time for this case to be thrown out. It was brought up on bogus charges from a district attorney who was dead set on putting Donald Trump behind bars.
In order for the country to unite as Trump assumes office in about a month, the hush money conviction is better off being dropped completely.
