Because Trump was delivered a major court victory after DA Fani Willis was forced to testify.
Embattled Fulton County District Attorney Fani Willis could be required to testify at a hearing later this week about when her relationship with Trump prosecutor Nathan Wade began, a judge said Monday.
The DA and Wade, whom Willis appointed as a special prosecutor in the Georgia election fraud case against the former president and over a dozen others, were both seeking to avoid testifying at a court hearing Thursday where Trump co-defendant Mike Roman will seek to have the criminal case against him dropped due to the prosecutors’ alleged misconduct.
However, Fulton County Superior Court Judge Scott McAfee stated in court on Monday that Roman’s counsel had “established a good faith basis” for the prosecutorial duo’s evidence as well as testimony from other DA personnel.
He also made it apparent that the hearing would center on Roman’s allegations about whether Willis profited financially by employing Wade and when they initially got intimately engaged.
He warned: “Disqualification can occur if evidence is produced demonstrating an actual conflict or the appearance of one.”
According to reports, Donald Trump has expressed interest in attending Thursday’s hearing, which would be his first appearance in Georgia court since he was accused alongside 18 others last August.
However, he must appear in a Manhattan courthouse at the same time for a hearing in the criminal case accusing him of directing “hush money” payments to two women in the run-up to the 2016 presidential election to keep them quiet about their claims they had affairs with Trump while he was married.
According to a source, Trump’s team has concluded that attending the Manhattan hearing is more vital, thus he will not travel to Georgia.
Although the hearing is related to Roman’s case, Trump’s lawyers are also contending that Willis tainted the case by introducing racial problems into it through her public comments since her relationship with Wade was revealed.
On Monday, McAfee stated that he would not hesitate to break short any questioning by Merchant that might bring “undue embarrassment” to Willis and other witnesses.
The judge ruled that Roman’s “star witness,” Terrence Bradley, Wade’s former law partner and divorce lawyer, would have to testify first, as Merchant seeks to disprove claims that a married Wade and Willis’ romantic relationship began after Wade began working on the Trump investigation, as well as claims that they never lived together.
Roman’s attorney, Ashleigh Merchant, argued earlier Monday. Bradley would testify that Willis and Wade’s connection began before he signed his first contract with the district attorney’s office in November 2021, a claim the couple refuted earlier this month, arguing their relationship did not become amorous until 2022.
Willis and Wade, who have been in a contentious divorce since 2021, were forced to come clean about the affair after Roman filed explosive papers in January seeking to have the criminal charges against him dropped and Willis disqualified from the case on the grounds that she allegedly profited from Wade’s lucrative appointment after he paid for her to accompany him on vacations.
Wade and Willis, however, stated in court filings submitted by the DA’s office on February 2 that their intimate relationship did not create a conflict of interest.
They stated they don’t live together, don’t share cash, and take turns paying for their travels.
Anna Cross, a DA’s office lawyer, said in a video Monday that Willis, Wade, or any of the other eight DA workers Roman subpoenaed to testify should not be forced to take the stand on Thursday.
