Trump Administration Targets New York Over CDL Violations

The Department of Transportation announced on Friday that New York has been issuing commercial driver’s licenses (CDLs) to nondomiciled individuals—those without permanent U.S. residence—in violation of longstanding federal regulations, prompting threats to withhold approximately $73 million in highway funding unless the state revokes the improper licenses and achieves full compliance.

A federal audit revealed that a staggering 53% of sampled nondomiciled CDLs in New York were issued unlawfully, with many valid for up to eight years despite holders having only short-term or expired work permits.

Transportation Secretary Sean Duffy called New York the “worst” offender among states, emphasizing rules that predate the current administration but were largely unenforced previously. “The mission is to get compliance to make sure we have safe drivers,” he said at a press conference. “We will pull every dollar possible from every single state that’s unwilling to work with this administration and these long-standing rules.”

Federal officials cited cases where New York issued eight-year licenses even after work permits had expired, such as one permit expiring in April followed by a CDL in September, or another in February despite a May expiration.

Prior Enforcement Success and Ongoing Safety Concerns

Duffy had earlier pressured California, leading Gov. Gavin Newsom to revoke 17,000 improperly issued nondomiciled CDLs. While praising California’s action on revocations, Duffy criticized the state for continuing to issue CDLs without enforcing English proficiency requirements, vital for road safety.

“If there is a crash, you have to be able to communicate with law enforcement: ‘What’s on your rig, where are you going?’” Mr. Duffy said.

California and New York together account for half of all nondomiciled CDLs nationwide, according to Duffy.

Recent deadly crashes involving migrant truck drivers have heightened scrutiny. Three people were killed in a Southern California freeway crash, with authorities charging Jashanpreet Singh—an individual who entered illegally and was released under prior policies—with vehicular manslaughter. Singh held a California-issued CDL despite reported limited English skills.

In another incident, Rajinder Kumar faced charges of criminally negligent homicide after a fatal Oregon collision; he too was licensed in California based on a temporary work permit.

Crackdown on Fraudulent Training and Road Safety

Duffy also vowed action against CDL “mills” that issue certifications without adequate training, allowing unqualified drivers to obtain licenses.

“If we’re going to have drivers on American roadways, they need to be the best,” he said.

The Trump administration’s enforcement of these existing rules aims to prioritize American road safety and qualified drivers. New York officials have pushed back, insisting compliance with federal standards, but the state has 30 days to address the audit findings or face funding penalties.
