A recent op-ed in The Hill suggesting that Congress could prevent Donald Trump from retaking office has sparked fierce backlash from the former president’s allies.

Trump’s communications director, Steven Cheung, denounced the idea as a “threat to Democracy” in a post on Thursday.

The op-ed, titled “Congress has the power to block Trump from taking office, but lawmakers must act now,” argues that individuals who have engaged in insurrection against the Constitution should be barred from holding office under the 14th Amendment.

Written by Democratic lawyers Evan A. Davis and David M. Schulte, the article outlines three points they claim support Trump’s disqualification: his impeachment over the January 6 attack, the Colorado Supreme Court’s finding that he “engaged in insurrection,” and the conclusions of the bipartisan investigation into the Capitol riot on January 6.

Cheung responded bluntly on X, formerly Twitter: “Oh, look. Democrats want to steal the election and invalidate the will of the American people. Threat to Democracy.”

Chris LaCivita, a former Trump 2024 campaign adviser, also weighed in, calling the authors “two idiots inciting an insurrection” and adding, “Remember the names: Congress has the power to block Trump from taking office, but lawmakers must act now.”

Eric Trump, the former president’s middle son, echoed the outrage, tweeting, “You people are sick.”

Meanwhile, billionaire and Trump ally Elon Musk chimed in, calling the op-ed “such a crazy thing for them to say” and labeling legacy media as “the propaganda arm of the radical left.”

The 14th Amendment, cited by the op-ed, includes a clause stating: “No person shall … hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath … to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.”

The article asserts that the evidence of Trump’s involvement in an insurrection is “overwhelming.” However, no members of Congress have recently acted on this argument.

Still, Democratic Rep. Jamie Raskin (Md.) previously supported the idea, citing Section 3 of the 14th Amendment as a clear basis for disqualification.

“Well, absolutely, and we’ve been saying all along that Section 3 of the 14th Amendment presents a clear and unequivocal statement that anyone who has sworn an oath of office,” Raskin told Dana Bash of CNN last year.

“And by the way, not just the president but members of Congress and others who hold federal office, who engage in insurrection or rebellion, having sworn an oath to uphold the Constitution against enemies foreign and domestic, can never serve again in federal or state office,” Raskin continued.

As the debate continues, Trump’s camp remains firmly opposed to any suggestion that his eligibility for office is in question, dismissing such arguments as politically motivated attacks aimed at undermining him and his presidential election victory.
