The Trump administration fired a shot across the bow on Wednesday, putting Maine on notice for defying President Donald Trump’s executive order that keeps biological males out of female sports. The warning signals a brewing showdown over fairness and federal authority, with the state digging in its heels.
Anthony Archeval, acting director of the Department of Health and Human Services (HHS) Office for Civil Rights (OCR), didn’t mince words in a statement to Fox News Digital. “What HHS is asking of the Maine Department of Education, the Maine Principals’ Association, and Greely High School is simple – protect female athletes’ rights. Girls deserve girls-only sports without male competitors,” he said.
He didn’t stop there, adding a stern promise: “And if Maine won’t come to the table to voluntarily comply with Title IX, HHS will enforce Title IX to the fullest extent permitted by the law.”
The heat turned up after the OCR dropped a bombshell on Monday, declaring that the Maine Department of Education, the Maine Principals’ Association, and Greely High School had each run afoul of Title IX. That’s the 1972 law banning s*x-based discrimination in education programs that get federal cash.
The trigger? A transgender-identifying boy snagged the top spot in the Maine Class B girls’ track and field championship for Greely High School back in February. Despite Trump’s order barring males from female teams, Maine let him compete—then doubled down, openly rejecting the president’s directive in favor of transgender males over female athletes.
The OCR didn’t waste time, firing off a determination letter to the trio. They’ve got ten days to promise compliance with Title IX or face a trip to the U.S. Department of Justice for what the letter calls “appropriate action.” No one’s guessing what that might mean—enforcement is clearly on the table.
Maine’s not backing down quietly. The Maine Principals’ Association clapped back in a statement to Fox News Digital, leaning hard on state law. “The alleged violation is due to MPA’s policy which is a direct result of the Maine Human Rights Acts mandate that athletes be allowed to participate on the teams which align with their gender identity. MPA’s policy is consistent with Maine State Law,” they argued.
They even questioned whether Title IX applies to them, pointing out that only a sliver of their funding trickles down from federal sources via member schools. Most of their money, they say, comes from ticket sales, sponsorships, and media deals. “It is MPA’s position that HHS does not have Title IX jurisdiction over MPA,” they claimed.
The association hinted at a bigger fight ahead, predicting the issue will land in the Maine legislature. MPA “looks forward to a robust debate,” they said, urging the public to keep it civil and leave student athletes out of the crossfire. “We urge all parties to this issue to air their questions, concerns, thoughts or opinions where they belong; in respectful debate in public hearings on the bills addressing this issue,” their statement said. “As always, we urge members of the public to keep this debate among adults and let our kids be kids. Please do not single any of our student athletes out, they are only abiding by the policy that the Maine Human Rights Act mandates.”
This all stems from Trump’s “Keeping Men out of Women’s Sports” executive order, designed to shield female athletes from competing against—or sharing locker rooms with—biological males. The order also puts federal funding on the line, directing agencies like HHS to yank grants from programs that don’t toe the line, all in the name of “safety, fairness, dignity, and truth” for women.
America’s Take: A One-Sided Debate the Left Won’t Face
Here’s the kicker: most Americans aren’t on board with biological males in girls’ sports. Polls consistently show a clear majority—often hovering around 60-70%—want sports divided by biological s*x, not gender identity. A 2023 Gallup survey found 69% of adults believe athletes should compete based on their birth s*x, a sentiment cutting across party lines more than you’d expect.
Even in blue-leaning states, the idea of boys racing against girls on the track or wrestling them on the mat doesn’t sit right with parents, coaches, and everyday folks who see it as a fairness issue, plain and simple.
Yet the political Left keeps pushing the opposite, framing it as a civil rights battle and dismissing the public’s unease as bigotry. Maine’s defiance is a perfect example—state officials and groups like the Maine Principals’ Association cling to laws like the Maine Human Rights Act, prioritizing transgender inclusion over what most voters actually want.
