Congresswoman Faces Federal Charges After Confrontation at ICE Detention Center
In a striking development out of Newark, New Jersey, a federal grand jury has indicted Representative LaMonica McIver (D-NJ) following a heated altercation outside an Immigration and Customs Enforcement (ICE) detention facility. The announcement came from interim U.S. Attorney for the District of New Jersey, Alina Habba, who detailed the charges in a recent post on X. McIver now faces a three-count indictment accusing her of “forcibly impeding and interfering with federal law enforcement officers” during the incident on May 9.
The confrontation unfolded when McIver, alongside other New Jersey Democrats, arrived at Delaney Hall’s ICE detention center, insisting on conducting what they described as “oversight.” Tensions escalated quickly, as captured by ICE body-cam footage, leading to a physical clash with Department of Homeland Security (DHS) agents.
According to a Department of Justice press release, McIver’s actions were central to the chaos. The indictment alleges that she physically intervened to prevent the arrest of Newark’s mayor, who had entered a restricted area. “Someone in the crowd yelled ‘circle the mayor,’” the DOJ noted, describing how McIver positioned herself to shield the mayor, wrapping her arms around him to block Homeland Security Investigations (HSI) agents.
The DOJ further alleges that McIver’s actions went beyond passive resistance. She reportedly slammed her forearm into one federal officer and grabbed another in an attempt to restrain them.
In a separate instance, she allegedly struck a second officer with both forearms while trying to disrupt the arrest. These actions form the basis of the charges, which carry a potential penalty of up to 17 years in prison if McIver is convicted.
In response, McIver has vowed to fight the charges, announcing her intent to plead not guilty. “The facts of this case will prove I was simply doing my job and will expose these proceedings for what they are: a brazen attempt at political intimidation,” she stated.
McIver framed the indictment as an extension of earlier charges, which she also disputes, accusing the Trump administration of using the legal system to silence her advocacy. “This indictment is not more justified than the original charges, and is an effort by Trump’s administration to dodge accountability for the chaos ICE caused and scare me out of doing the work I was elected to do. But it won’t work — I will not be intimidated,” she declared.
U.S. Attorney Habba, however, emphasized the importance of protecting federal officers in her X post. “As I have stated in the past, it is my Constitutional obligation as the Chief Federal Law Enforcement Officer for New Jersey to ensure that our federal partners are protected when executing their duties,” she wrote.
Habba stressed that while individuals are free to voice their opinions on policy matters, endangering law enforcement or the communities they serve crosses a critical line. She described the grand jury’s decision as a step toward justice, pledging that her office would pursue the case to its conclusion.
