Habba had been serving as interim U.S. attorney until her term expired in July. Rather than following established procedures, Trump and Bondi exploited gaps in federal vacancy laws to designate her as “acting” U.S. attorney, a move designed to extend her tenure.

The case landed before Brann after the chief judge of the Third Circuit Court of Appeals, which oversees New Jersey and Pennsylvania, ruled that New Jersey’s federal judges faced a conflict of interest. In an unusual move, those judges had refused to extend Habba’s term and instead appointed Desiree Grace, a veteran career attorney, to the role.

Trump and Bondi countered, firing Grace, withdrawing Habba’s nomination for permanent U.S. attorney, and reinstalling her as acting U.S. attorney, claiming this allowed her to remain in the position for an additional 210 days under federal law.

Brann’s ruling puts a stop to Habba’s ability to prosecute Giraud and the other defendant who challenged her appointment, dealing a significant blow to Trump’s efforts to control key legal positions.
