Explosive allegations from FBI Director Kash Patel and Deputy Director Dan Bongino have reignited scrutiny over the 2020 U.S. presidential election, with claims that the bureau’s former leadership concealed evidence of a Chinese scheme to influence the vote in favor of Joe Biden. The accusations, detailed in a statement to reporters, suggest that prior FBI officials “chose to play politics” by withholding critical intelligence about a plot involving fake mail-in ballots. While these claims are serious, they remain unsubstantiated, casting a shadow over the Biden administration’s early days while raising questions about transparency in federal law enforcement.

The allegations stem from a recently surfaced intelligence report, turned over to Congress by Patel earlier this month, which purportedly details a Chinese operation to produce fraudulent U.S. driver’s licenses. According to the report, these licenses were intended to enable tens of thousands of ineligible voters—allegedly Chinese students and immigrants sympathetic to the Chinese Communist Party (CCP)—to cast mail-in ballots for Biden during the 2020 election. The timing of the report’s emergence, five years after the election, fuels skepticism about its credibility and the motives behind its release.

Patel’s discovery of the intelligence report was spurred by information from Senate Judiciary Committee Chairman Chuck Grassley, R-Iowa, who received tips from whistleblowers about the alleged cover-up. Grassley’s role in pushing for transparency has been praised by Patel and Bongino, who vowed to work with the senator to uncover more details. “Thanks to the great Oversight work of Chairman Grassley, the information the old FBI regime covered up will now be released to the public,” they stated, emphasizing their commitment to “aggressive transparency” to restore public trust in the FBI.

The intelligence report, dated August 2020, was reportedly never fully investigated or corroborated, according to officials.. Instead, it was recalled from intelligence agencies around the time then-FBI Director Chris Wray testified before Congress that there were no known foreign interference plots targeting the 2020 election. This testimony, given as Biden secured victory over Donald Trump, now faces renewed scrutiny as critics question whether the Biden administration inherited a system that downplayed potential threats.

The recall notice for the intelligence report instructed other spy agencies to destroy their copies of the document. “This report was recalled in order to re-interview the source. Recipients should destroy all copies of the original report and remove the original report from all computer holdings,” the notice read. Such an action raises concerns about whether the FBI, under its previous leadership, sought to suppress information that could have sparked public debate during a highly contentious election season.

The intelligence bulletin itself, titled “Chinese Government Production and Export of Fraudulent US Driver’s Licenses to Chinese Sympathizers in the United States, in Order to Create Tens of Thousands of Fraudulent Mail-in Votes for US Presidential Candidate Joe Biden, in late August 2020,” outlines a bold alleged scheme. It claims the Chinese government leveraged data collected from millions of TikTok accounts, including names, IDs, and addresses, to create convincing fake driver’s licenses. These licenses, the report alleges, used real U.S. citizens’ information to evade detection, enabling fraudulent mail-in votes.

“In late August 2020, the Chinese government had produced a large amount of fraudulent United States driver’s licenses that were secretly exported to the United States,” the report reads. It further claims that these licenses were designed to “account for tens of thousands of mail-in votes” for Biden, exploiting the surge in mail-in voting prompted by the COVID-19 pandemic. The specificity of the report’s details contrasts sharply with its lack of corroboration, leaving open questions about its reliability.

Patel and Bongino’s accusations point to a pattern of alleged mismanagement within the FBI during the 2020 election cycle. “Based on our continued review and production of FBI documents related to the CCP’s plot to interfere in the 2020 U.S. Presidential election, previous FBI leadership chose to play politics and withhold key information from the American people – exposing the weaponization of law enforcement for political purposes during the height of the 2020 election season,” they said. Their statement suggests a deliberate effort to obscure evidence, though no concrete proof of such intent has yet emerged.

The timing of these revelations, years after Biden’s inauguration, complicates their impact. Critics argue that the Biden administration’s failure to address or acknowledge such intelligence—if it was indeed suppressed—could erode public confidence in its commitment to election integrity. Yet, without substantiation, the claims risk being dismissed as politically motivated, especially given their emergence under new FBI leadership appointed after Biden’s term began.

The report’s allegations about China’s use of TikTok data add another layer of intrigue, given the app’s controversial presence in the U.S. at the time. The claim that the CCP harvested personal information to facilitate election interference aligns with ongoing concerns about foreign influence in American politics. However, the lack of follow-up investigation in 2020 leaves these assertions in limbo, with no clear evidence linking them to actual voter fraud.

Patel and Bongino have promised to deliver more transparency, stating, “This FBI leadership team will continue keeping our promise of aggressive transparency and working around the clock to fix the underlying problems to restore the FBI to the trusted institution the American people deserve.” Their pledge aims to distance the current FBI from its predecessors.

As the FBI continues to release documents related to the alleged plot, the Biden administration faces growing pressure to respond to questions about its predecessors’ handling of election security.
