Pentagon Takes Action Against Kelly Over Controversial Video
Secretary of War Pete Hegseth announced that the Department of War is pursuing administrative measures against Sen. Mark Kelly (D-Ariz.) following a Pentagon investigation into a video he appeared in last November. The video, which featured Kelly and five other Democratic lawmakers urging military personnel to disregard illegal orders, has been labeled as reckless and aimed at disrupting military discipline. As a retired Navy captain still drawing a pension, Kelly is the sole participant from the group subject to the Uniform Code of Military Justice, prompting a review of his rank and potential demotion.
“Six weeks ago, Senator Mark Kelly — and five other members of Congress — released a reckless and seditious video that was clearly intended to undermine good order and military discipline,” Hegseth stated.
“In response to Senator Mark Kelly’s seditious statements — and his pattern of reckless misconduct — the Department of War is taking administrative action against Captain Mark E. Kelly,” he added.
Details Emerge on Probe and Potential Penalties
The probe, initiated after President Trump’s public condemnation of the video as “SEDITIOUS BEHAVIOR, punishable by DEATH” (though he clarified he wasn’t advocating for executions), led to Kelly receiving a formal censure letter.
This document, to be added to his permanent military file, warns of further consequences for ongoing misconduct and has triggered retirement grade determination proceedings that could lower his rank and reduce his pension.
Hegseth emphasized Kelly’s accountability, saying, “As a retired Navy Captain who is still receiving a military pension, Captain Kelly knows he is still accountable to military justice. And the Department of War — and the American people — expect justice.”
The letter explicitly states, “If you continue to engage in conduct prejudicial to good order and discipline, you may subject yourself to criminal prosecution or further administrative action.”
Kelly has 30 days to reply, with Hegseth required to conclude the process within 45 days. Navy Secretary John Phelan is overseeing the rank review.
Kelly’s Defiant Response Amid Broader Backlash
Kelly, a former NASA astronaut, pushed back against the actions, framing them as an assault on his rights and service record. He accused Hegseth of intimidation tactics.
“My rank and retirement are things that I earned through my service and sacrifice for this country. I got shot at. I missed holidays and birthdays. I commanded a space shuttle mission while my wife Gabby recovered from a gunshot wound to the head– all while proudly wearing the American flag on my shoulder. If Pete Hegseth, the most unqualified Secretary of Defense in our country’s history, thinks he can intimidate me with a censure or threats to demote me or prosecute me, he still doesn’t get it. I will fight this with everything I’ve got,” Kelly declared.
The other lawmakers in the video—Sen. Elissa Slotkin (D-Mich.) and Reps. Jason Crow (D-Colo.), Maggie Goodlander (D-NH), Chris Deluzio (D-Pa.), and Chrissy Houlahan (D-Pa.)—include several veterans, but none face similar military repercussions as they are not retired servicemembers under the same jurisdiction.
