Trump DOJ Intervenes in xAI Lawsuit Against Colorado AI Regulations

The Department of Justice under the Trump administration has joined Elon Musk’s xAI in challenging a Colorado state law that critics argue disguises efforts to impose diversity, equity, and inclusion (DEI) standards on artificial intelligence developers.

The intervention marks the DOJ’s first constitutional challenge involving AI.

The lawsuit targets a 2024 consumer protection bill signed by Democratic Gov. Jared Polis, which requires “high-risk” AI developers like xAI — creator of the Grok platform — to take “reasonable care” to prevent “algorithmic discrimination” based on protected classes such as race and religion.

Supporters of the suit view the move as a defense of merit-based innovation and free speech against burdensome state mandates.

DOJ Civil Rights Division head Harmeet Dhillon stated:

“We join @xai’s landmark suit, and stand against woke DEI standards being imposed by Colorado.”

Allegations of Viewpoint Discrimination and Equal Protection Concerns

xAI and the DOJ contend that the law violates the First and 14th Amendments by compelling AI systems to favor certain demographic outcomes under the guise of preventing discrimination.

Government lawyers argued the bill “fosters further discrimination” by permitting developers to prioritize “diversity or redress historical discrimination.”

The complaint from xAI further claims the law would force the company to alter Grok’s outputs to align with “a controversial, highly politicized viewpoint.”

“By requiring ‘developers’ and ‘deployers’ to differentiate between discrimination that Colorado disfavors and discrimination that Colorado favors, SB24-205 compels Plaintiff xAI — a ‘developer’ under the law — to alter Grok, forcing Grok’s output on certain State-selected subjects to conform to a controversial, highly politicized viewpoint.”

The law has drawn parallels to Colorado’s recent Supreme Court losses in cases involving speech and religious freedoms, including decisions on conversion therapy bans and wedding website design.

Broader Implications for AI Leadership and State Regulations

Critics, including the libertarian CATO Institute, warn that such rules could lead developers to restrict lawful speech in the name of compliance, potentially undermining America’s position as the global leader in AI.

The case is seen by some as another test of how far states can push regulatory boundaries in emerging technology.
