Federal Judge Blocks Trump Administration’s National Guard Deployment to Portland

A federal judge issued a restraining order late Sunday prohibiting the Trump administration from deploying National Guard troops from other states to Portland, Oregon, in response to ongoing protests against Immigration and Customs Enforcement operations.

The ruling by U.S. District Judge Karin Immergut, a Trump appointee, follows her earlier decision barring the federalization of Oregon’s National Guard, which she deemed unwarranted given the scale of local unrest.

The new order came after the Defense Department indicated plans to mobilize troops from outside Oregon, prompting Immergut to convene an emergency hearing Sunday evening.

“Defendants are temporarily enjoined from deploying federalized members of the National Guard in Oregon,” the judge directed in her filing.

Background of Portland Protests and Prior Rulings

Portland has seen intermittent protests targeting ICE facilities for years, including violent clashes that forced the temporary closure of an ICE office during the first Trump administration and nightly attacks on the federal courthouse in 2020, which were among the most prolonged incidents of Black Lives Matter demonstrations nationwide.

Immergut’s initial ruling stated that the current protests do not constitute the level of disruption required to justify National Guard involvement.

She further noted that the administration’s actions “risk blurring the line between civil and military federal power.”

President Trump has argued that the demonstrations have impeded ICE’s operations, necessitating the transfer of agents from other areas to sustain services, which he cited as evidence for the need for additional support.

The judge countered that such disruptions are manageable without military intervention. In a related case, Trump deployed troops to Los Angeles in June to address similar immigration enforcement issues; a district court halted the action, but the 9th U.S. Circuit Court of Appeals overturned that decision.

Appeals Process and State Response

The Justice Department has appealed Immergut’s latest ruling to the 9th U.S. Circuit Court of Appeals, which has jurisdiction over both California and Oregon. Oregon Governor Tina Kotek described the decision as a significant victory in the state’s legal challenge.

“The rule of law must stand. This is not just about Oregon or a handful of states anymore — it’s about the integrity of our democracy,” Kotek said in a statement.
