House Panel Report Accuses Andrew Cuomo of “Medical Malpractice” in Handling of Nursing Home Deaths During Pandemic
Former New York Governor Andrew Cuomo has been accused of “medical malpractice” and publicly misrepresenting the true number of COVID-19 nursing home deaths during the pandemic’s peak, according to a scathing final report released by the Republican-led House Select Subcommittee on the Coronavirus Pandemic. The findings, made public on Monday, also allege that Cuomo “likely gave false statements” regarding his role in key pandemic decisions.
The report highlights Cuomo’s direct involvement in a controversial March 2020 directive requiring nursing homes to accept recovering COVID-19 patients, a policy that has drawn widespread criticism. It also accuses Cuomo of downplaying nursing home fatalities in a July 2020 state report, actions that the House panel claims undermined public trust and hampered pandemic response efforts.
Adding to the allegations, the report states Cuomo “acted in a manner consistent with an attempt to inappropriately influence the testimony of a witness and obstruct the Select Subcommittee’s investigation,” referencing his communications with former adviser James Malatras.
The committee’s findings cap a lengthy investigation into Cuomo’s handling of the pandemic. Spanning over 500 pages, the final report provides an exhaustive account of the former governor’s decisions and their impact on public health. Cuomo’s name appears 203 times in the document, with a dedicated 40-page section scrutinizing his and New York state’s pandemic response.
One particularly damning conclusion is that Cuomo “Likely Gave False Statements to the Select Subcommittee in Violation of 18 U.S.C,” a federal crime carrying a potential five-year prison sentence if proven. In October, the committee referred these statements to the U.S. Department of Justice for possible prosecution.
Cuomo Denounces Report as Partisan Attack
Cuomo, who resigned in 2021 amid s*xual misconduct allegations he denies, dismissed the report as politically motivated. His spokesperson, Richard Azzopardi, characterized the investigation as a partisan effort by “MAGA Republicans” to target their opponents.
“This is the same weak gruel the MAGA Republicans on this committee have been peddling for months if not years,” Azzopardi said. He added that previous investigations by the Department of Justice and other authorities found no wrongdoing on Cuomo’s part regarding nursing home policies.
Azzopardi also cited federal data ranking New York 39th in per capita nursing home deaths in 2020. “From the very beginning, this has been an abuse of power and a waste of taxpayer money aimed at punishing perceived political enemies,” he said, mentioning Dr. Anthony Fauci and Cuomo himself as alleged targets.
Families of Victims Respond
For families who lost loved ones in nursing homes during the pandemic, the report is a long-overdue reckoning. Peter Arbeeny, whose father died of COVID-19 after being discharged from a Brooklyn nursing home, expressed frustration with Cuomo’s defense.
“Cuomo has been lying about following the Trump CDC guidelines for years,” Arbeeny said. He argued that if Cuomo’s administration had fully utilized resources like the USS Comfort hospital ship and the Javits Center, “thousands of lives would have been saved.”
A Devastating Reassessment
Despite Cuomo’s denials, Rep. Brad Wenstrup, the Republican chair of the subcommittee, emphasized bipartisan agreement on key points in the report. He noted in the opening letter that the investigation found Cuomo’s decisions during the pandemic were harmful and avoidable.
The report serves as a detailed rebuke of Cuomo’s leadership during a critical period of the pandemic, providing a stark account of what the subcommittee describes as “medical malpractice” and efforts to obscure the truth.
