Because a Federal Just hit Donald Trump and Jim Jordan with a shocking court ruling.
Alvin Bragg, the Manhattan district attorney, attempted to have a former prosecutor in his office barred from appearing before the House Judiciary Committee, but a federal judge rejected his arguments.
Former prosecutor Mark Pomerantz, who is due to testify at 10 a.m. on Thursday, was ordered by U.S. District Court Judge Mary Kay Vyskocil to “appear for the congressional deposition,” according to her judgment on Wednesday.
According to the New York Post, the committee, which is presided over by Ohio Republican Rep. Jim Jordan, said the subpoena was issued to find out whether government monies were utilized in the investigation of former President Donald Trump.
Bragg’s inquiry led to 34 criminal counts against Trump for allegedly fabricating corporate records.
CNN reports that although Bragg’s office indicated it will challenge Vyskocil’s decision, it lost the case on Wednesday night when she denied Bragg’s request for a stay of the order while the challenge is being made.
In 2022, Pomerantz, a special assistant district attorney, resigned due to Bragg’s failure to charge Trump. According to ABC News, he later authored a book on the incident.
Jordan’s spokesman applauded the judge nominated by Trump for the decision.
“Today’s decision shows that Congress has the ability to conduct oversight and issue subpoenas to people like Mark Pomeranz, and we look forward to his deposition before the Judiciary Committee,” Russell Dye said.
In what she described as a political fight, Vyskocil said that her decision did not support either side.
“In our federalist system, elected state and federal actors sometimes engage in political dogfights,” the judge wrote in the decision.
“The sole question before the Court at this time is whether Bragg has a legal basis to quash a congressional subpoena that was issued with a valid legislative purpose. He does not.”
She also criticized Bragg’s handling of the case as being “unpersuasive.”
“Bragg’s throw-everything-at-the-wall approach to privilege is unpersuasive,” the Judge claimed.
Vyskocil added that there are many political undertones to the case.
The early decision from the Federal Judge Vyskocil is a huge win that Donald Trump and Jim Jordan were looking for in the early parts of the case.
It shows that the Bragg team has their work cut out for them if they want to convince a judge and jury of Donald Trump’s alleged crimes while the vast majority of people believe this case to be a political show.
