Vice President Kamala Harris has shown support for disturbing new legislation that could bring significant changes to the U.S. Supreme Court, according to a leading Democratic senator.

The proposed reforms, spearheaded by Senator Sheldon Whitehouse (D-R.I.), would involve appointing a new justice every two years, a dramatic shift in how the nation’s highest court operates.

“They have not gone so far as to say, ‘We endorse your bill.’ They have said that your bills are precisely aligned with what we are talking about,” Whitehouse shared during an interview with The Dispatch.

The comment reflects a strong alignment between the Harris campaign and Whitehouse’s bill, which he introduced last October. The bill aims to radically restructure the Supreme Court and alter the process of judicial appointments.

Under the proposed legislation, presidential appointments to the Supreme Court would occur on a regular, biennial basis. Only the nine most recently appointed justices would be allowed to preside over “appellate jurisdiction” cases.

These are the most consequential cases, often touching on issues of national importance, such as the landmark Dobbs v. Jackson Women’s Health Organization decision and cases involving presidential immunity.

The bill also proposes that after 18 years of service in appellate jurisdiction cases, justices would transition to hearing a limited number of “original jurisdiction” cases—matters that generally involve disputes between states.

Last month, both President Biden and Vice President Harris publicly endorsed the idea of revising the Supreme Court’s structure, advocating for a system where a new justice would be appointed every two years and serve an 18-year term in active service.

However, the proposal was vague on specifics, leaving unanswered questions about whether these reforms would be implemented via congressional legislation, a constitutional amendment, or executive action.

Speaking on the sidelines of the Democratic National Convention, Whitehouse hinted that Democrats are preparing to push through sweeping legislative reforms if they secure a majority in government after the November elections.

“To get around the filibuster, we’re going to have to have a process that allows very substantial debate from the Senate minority,” Whitehouse explained at an event hosted by the Brennan Center for Justice.

He added that the package would likely include not only Supreme Court reforms but also measures to protect abortion, restore voting rights, and curb the influence of billionaire-backed political contributions.

Whitehouse expressed confidence that such a bill would have “spectacular tailwinds behind it” if it reached Congress, signaling optimism about its potential passage.

Senate Majority Leader Chuck Schumer also confirmed at the convention that eliminating the filibuster would be a top priority if Harris were to defeat former President Donald Trump and if Democrats gained control of both the House and Senate.

Schumer acknowledged that the effort to end the filibuster fell short after the 2022 midterms due to opposition from key senators like Kyrsten Sinema of Arizona and Joe Manchin of West Virginia.

Both lawmakers, however, are set to leave the Senate next year, clearing the way for Democrats to reconsider the move.

These disturbing plans by the Democrats should be nothing short of terrifying to any sensible American.
