“I am demanding the DOJ investigate whether President Biden’s cognitive decline allowed unelected staff to push through radical policy without his knowing approval,” Bailey declared, not mincing words. “If true, these executive orders, pardons, and all other actions are unconstitutional and legally void.”

Among the orders stamped with the autopen? A notable August 2022 directive aimed at protecting abortion access in emergencies, and a December 2024 command to shutter government offices on January 9, 2025, in tribute to the late President Jimmy Carter, according to Heritage’s findings.

To dig deeper, the New York Post took a quick peek at roughly three dozen executive order signatures from Biden, former President Barack Obama, and President Donald Trump, as logged in the Federal Register. Each president’s signature stayed consistent over time—though the New York Post’s snapshot was far less exhaustive than Heritage’s deep dive.

Autopen signatures are churned out by a machine, not a human hand. Presidents as far back as Harry Truman have reportedly relied on this time-saving tech.

“We gathered every document we could find with Biden’s signature over the course of his presidency,” the Oversight Project revealed last week. “All used the same autopen signature except for the announcement that the former President was dropping out of the race last year.”

The group showcased Biden’s signatures on two executive orders—both carbon copies of each other—then juxtaposed them with his signature on the 2024 race withdrawal letter.

That one stood apart: slight quirks in the lettering, and “Jr.” swapped for a simpler “J.R. Biden.” Meanwhile, Biden was no stranger to the public stage, often seen pen in hand at signing ceremonies. Just how much he leaned on the autopen? That’s still a mystery.

Taking a swipe at Biden’s mental decline, the Oversight Project quipped, “whoever controlled the autopen controlled the presidency.”

Biden’s mental fitness was a hot-button issue throughout his term. By the end, he’d clinched the title of America’s oldest president at 82—though Trump, now 78, is poised to snatch that record soon.

Biden’s public slip-ups didn’t help: mangled words, moments of disorientation, even switching to a shorter staircase for Air Force One boardings. His team brushed it off, insisting he was sharp as ever—until that fateful June debate with Trump.

Frozen expression, raspy voice, and a mind that seemed to wander, Biden’s performance sparked a Democratic uprising. Three weeks later, he was out of the race.

“There are profound reasons to suspect that Biden’s staff and political allies exploited his mental decline to issue purported presidential orders without his knowing approval,” Bailey charged in a fiery letter to the DOJ watchdog.

He even pointed to House Speaker Mike Johnson (R-La.), who claimed Biden once forgot about a natural gas executive action during a private chat.

The autopen controversy isn’t new. George W. Bush had the Justice Department weigh its legality—deemed constitutional, yet he steered clear, wary of future challenges, per ABC News.
