Maine Democrats Push to Enshrine Transgender Sports Rights in State Constitution

In a bold move, Maine’s Democratic House Majority voted on Thursday to advance a bill that would cement the right of transgender-identifying males to compete in female sports by embedding the Maine Human Rights Act (MHRA) into the state’s constitution.

The legislation, known as LD 260, squeaked through with a narrow majority but faces a steeper challenge ahead, requiring two-thirds support in both legislative chambers before it can reach voters, according to Fox News.

The MHRA, Maine’s cornerstone anti-discrimination law, has been at the heart of a heated clash with the Trump administration. State officials have leaned on the law, which added “gender identity” protections in 2021, to defend their policy allowing transgender girls to participate in female sports and access female spaces.

“Our position is that Title IX, consistent with the Maine Human Rights Act, so both federal and state law, supports that trans girls will be able to participate in high school sports consistent with their gender identity,” Maine Attorney General Aaron Frey said during an interview with CNN. “So my contention is Maine is following Title IX, Maine is following the Maine Human Rights Act.”

Meanwhile, Maine Republicans are pushing back, advocating to remove “gender identity” from the MHRA altogether.

The vote on LD 260 came just one day after the U.S. Department of Justice (DOJ) slapped Maine with a lawsuit, accusing the state of defying President Trump’s executive order, “Keeping Men Out of Women’s Sports.”

The order reinterprets Title IX to bar males from competing in female sports, aiming to ensure fairness and safety for female athletes.

The DOJ’s complaint pulls no punches, alleging that Maine is “openly and defiantly flouting federal anti-discrimination law.” It argues, “By prioritizing gender identity over biological reality, Maine’s policies deprive girl athletes of fair competition, deny them equal athletic opportunities, and expose them to heightened risks of physical injury and physiological harm.”

Trump’s executive order, designed to shield female athletes from having “to compete with or against or having to appear unclothed before males,” also puts federal funding on the line.

It directs agencies to review grants to education programs and, where necessary, pull funding from those that don’t comply with the policy, which champions women’s “safety, fairness, dignity, and truth.”

Maine officials, however, have dug in their heels. Citing state law that allows students to compete on teams matching their “gender identity,” they’ve openly refused to align with the federal mandate. The tension escalated in February when a transgender-identifying boy clinched the Maine Class B championship for the Greely High School girls’ track and field team, spotlighting the issue.

The feud reached a public boiling point on February 20 at the Republican Governor’s Association dinner, where President Trump warned Maine Governor Janet Mills that the state risks losing federal funding if it continues to allow males in female sports.

“We are the federal law. You better do it, because you’re not gonna get any federal funding if you don’t… your population also doesn’t want men in women’s sports,” Trump declared. “You better comply, or you’re not getting any federal funding.”

Mills fired back, “See you in court.” “Good. See you in court, that should be a real easy one,” Trump retorted. “Enjoy your life after, governor. I don’t think you’ll be in elected office.”

The fallout has been swift. The Departments of Education and Health and Human Services launched probes into Maine’s policies, ultimately finding that the Maine Department of Education as well as other entities are in violation of Title IX. The Department of Education has since initiated steps to cut federal K-12 funding to the state, while the USDA’s attempt to freeze funding was halted by a federal court.

As Maine braces for a legal and political showdown, the debate over transgender inclusion in sports continues to ignite fierce passions, pitting state autonomy against federal authority and fairness in competition against individual identity.
