Donald Trump Gag Order Continues

In a recent legal setback, former President Donald Trump was denied an appeal to lift a gag order in the New York criminal hush money case.

The order had been imposed following statements from Trump’s opponent in the 2024 presidential election, Vice President Kamala Harris, who referred to the race as a choice between “a prosecutor and a convicted felon.”

Trump’s legal team argued that the gag order unfairly limits his ability to counter Harris’s remarks and campaign against her.

On July 30, Trump’s attorneys petitioned the New York appeals court to expedite the removal of the gag order, asserting that it infringes on his First Amendment rights.

They contended that Trump is unable to defend himself against political attacks due to the restrictions, which prohibit him from publicly discussing individual prosecutors in Manhattan District Attorney Alvin Bragg’s office until his sentencing on September 18.

Harris, who recently became the presumptive Democratic nominee after President Joe Biden withdrew from the race, has highlighted Trump’s legal troubles as a central theme in her campaign.

This focus on Trump’s conviction in the 34-count felony case has been a point of emphasis in Harris’s strategy, as noted in a filing by Trump’s attorney Todd Blanche.

Blanche argued that Trump faces ongoing threats of punishment and fines for potential violations of the gag order. Despite a partial lifting of the gag order by Justice Juan Merchan, the restrictions remain significant.

Trump is still barred from making statements about individual Manhattan prosecutors, court personnel, and the families of prosecutors and the judge involved in his case.

The former president and his allies have criticized the justice system as being “weaponized” against him.

They have particularly pointed to the involvement of Matthew Colangelo, who moved from a senior position in the Justice Department to work for District Attorney Bragg, a Democrat.

This move has been scrutinized, though there is no evidence suggesting a deliberate effort by the Biden administration to target Trump.

In addition to challenging the gag order, Trump’s legal team is seeking to overturn the conviction entirely.

They argue that a recent Supreme Court decision on presidential immunity should nullify the jury’s findings from late May.

As Trump navigates multiple criminal cases, the gag order remains a contentious issue, affecting his ability to fully engage in the political discourse leading up to the 2024 election.
