Biden’s latest appointment just shredded the Constitution in front of Congress

And Biden’s latest appointment just shredded the Constitution in front of Congress.

Most of the news has been filled with Joe Biden’s constant scandals surrounding his mishandling of classified information.

What people are forgetting is Biden is still in control and tightening his grip on the executive branch with every appointment.

And his latest appointment just showed their complete incompetency for every single American to see.

On Wednesday, a left-leaning judge couldn’t answer simple questions regarding the US Constitution during a Senate Judiciary Committee hearing for President Joe Biden’s Federal District Court nominees.

Senator John F. Kennedy (R-LA) started by questioning Judge Charnelle Bjelkengren, nominee for the Eastern District of Washington, regarding Article V of the United States Constitution.

Bjelkengren responded, “Article V is not coming to mind at the moment.” Article V describes the procedure for amending the Constitution.

Then Kennedy asked, “Okay, how about Article II?”

“Neither is Article II,” responded Bjelkengren. Article II establishes the executive branch of the federal government and defines its roles and responsibilities.

“Do you know what ‘Purposivism’ is?” Kennedy said of the judge after a little pause,  reflecting the legal principle that statutes should be read according to their “purpose,” as opposed to the plain text meaning.

The judge replied, “Um, in my 12 years as an Assistant Attorney General, uh, and my nine years serving as a judge, I was not faced with that precise question. Um, we are the highest trial court in Washington State, so I’m frequently faced with, um, issues that I’m not familiar with, and I thoroughly review the law, our research, and apply the law to the facts presented to me.”

“Well, you’re gonna be faced with it if you’re confirmed, I can assure you.” Kennedy said. He then shifted his attention to the next candidate, Matthew P. Brookman of the Southern District of Indiana.

Kennedy returned to Bjelkengren after questioning the other nominees.

“Can you tell me what the Independent State Legislature Theory is?” Kennedy inquired. “I’m just asking you not your opinion, just what is it? It’s before the Supreme Court now.”

“Uh, in my 12 years as a Washington State Assistant Attorney General…” Bjelkengren said again. “Right,” Kennedy muttered, before the judge continued, “and that particular, um, doctrine was not presented to me.”

Moore v. Harper, which is currently before the United States Supreme Court, involves challenges to North Carolina’s congressional map and the Independent State Legislature Theory, which contends that the US Constitution grants state elected officials near-absolute power to regulate federal elections without any checks and balances from state courts, governors, or other bodies with legislative power.

Bjelkengren previously worked as an Assistant Attorney General in the Washington State Attorney General’s office and as an Administrative Law Judge for the Office of Administrative Hearings in Washington State. He is currently a judge on the Spokane County Superior Court. She was appointed to the Spokane County Superior Court by Democrat Governor Jay Inslee after Democratic Senator Patty Murray recommended her nomination.

Bjelkengren was nominated by President Joe Biden to fill the seat vacated by Judge Salvador Mendoza Jr., who was elevated to the Ninth Circuit Court of Appeals.

Michael Farbiarz for the District of New Jersey, Robert Kirsch for the District of New Jersey, and Eleta Merchant for the Eastern District of New York were the other nominees at the hearing.
